AGREEMENT TO TERMS OF SERVICE

I. Acceptance of Terms


This Private Membership Agreement (the “Agreement”) is entered into by and between HCU Mushrooms Ltd Private Membership Association (the “Association”), an auxiliary of the Colorado non-profit corporation HCU Education Ltd, doing business as Church of Higher Consciousness Unlimited, and the undersigned individual (the “Member”). By signing this Agreement and/or by accessing or utilizing any website, social media platform, or related online service maintained by HCU Mushrooms Ltd and/or Church of Higher Consciousness Unlimited, the Member acknowledges that they have read, understood, and agree to be bound by the terms and conditions set forth herein.

II. Objectives and Principles

  1. Purpose and Mission:
    The primary objective of the Association is to uphold and enhance the civil rights, constitutional guarantees, political freedom, and the common-law right of self-determination as enshrined in the United States Constitution and the Universal Declaration of Human Rights (UDHR). The Association seeks to achieve this objective by providing a private forum wherein members may convene, exchange ideas, and engage in private business transactions. Such activities shall remain within the domain of private affairs and be protected by the U.S. Constitution, the UDHR, common law, and all prior guarantees.

  2. Fundamental Rights:
    The Association reaffirms that the First Amendment of the United States Constitution guarantees members the rights to freedom of religion, speech, petition, assembly, and the lawful pursuit of collective action in the defense of their constitutional rights. In addition, members are entitled to protection against unreasonable search and seizure, the right against self-incrimination, and all other inalienable rights provided by federal and state constitutions, statutes, common law, and the UDHR. The Association also recognizes the common-law right to self-determination in healthcare decisions, as acknowledged by the Fourteenth Amendment of the U.S. Constitution.

  3. Autonomy in Advisement:
    Each member retains the right to determine independently which fellow members are best suited to provide counsel and advice regarding education, physical, spiritual, and mental healthcare, among other matters. Members may choose those deemed most competent to facilitate the delivery of guidance, treatment, or care.

  4. Freedom of Treatment and Choice:
    The Association upholds the freedom of each member to independently select and perform the therapies and treatments they deem appropriate for diagnosing, treating, and preventing illness, as well as for achieving and maintaining overall physical, mental, and spiritual well-being. This freedom extends to any modality of treatment—whether traditional or nontraditional—and includes the liberty to seek assistance in legal or private business matters.

  5. Private Domain and Business Conduct:
    The mission of the Association is to provide a private forum for conducting business among its members. All interactions and transactions shall be confined to the private domain and shall enjoy the full protection afforded by the constitutional and legal frameworks referenced above.

  6. Membership Inclusivity:
    The Association shall recognize as a member any individual who aligns with these principles and policies, irrespective of race, color, or religion. The Association shall facilitate a medium through which members may collaborate to fulfill the purposes set forth in this Agreement.

  7. Termination of Membership:
    Membership in the Association, as well as in HCU Mushrooms Ltd, Church of Higher Consciousness Unlimited, and any affiliated groups, may be terminated at the discretion of the Association Board or its designee. Such termination may occur if a member is deemed to be acting in a manner that is contrary or detrimental to the principles, welfare, or objectives of the Association.

  8. Nature of Membership Relationship:
    By joining HCU Mushrooms Ltd, the undersigned voluntarily elects to transition from a public individual or patient to a private member of the Association. The Member acknowledges that any services, products, advice, or care provided by fellow members are offered solely in a private, contractual capacity. No doctor-patient, provider-patient, client-vendor, or customer-vendor relationship is established under this Agreement. The Member accepts full responsibility for evaluating any advice or recommendations received and agrees to hold harmless fellow members, staff, and the Association from any resulting liability—except in cases where harm arises from a clear and present danger as defined by the United States Supreme Court.

  9. Jurisdiction and Dispute Resolution:
    Recognizing the protections afforded by the First and Fourteenth Amendments to the U.S. Constitution and the UDHR, the Association’s affairs shall remain outside the jurisdiction of federal and state regulatory agencies. All disputes, complaints, or grievances shall be resolved by a designated committee or designee of the Association, thereby waiving any statutory claims related to HIPAA privacy or complaint processes. Medical or healthcare records maintained by the Association shall be regarded as confidential and will only be disclosed upon the Member’s written request. Any breach of these provisions may subject the Member to legal proceedings.

  10. Confidentiality of Activities:
    The Member’s interactions within the Association shall be regarded as a private contractual matter, exempt from disclosure to any governmental or regulatory body. All records and documents shall remain the property of the Association. The Member further agrees not to initiate any legal action, including claims of malpractice, against any fellow member unless exposed to a clear and present danger of substantive harm. This Agreement is entered into voluntarily, without coercion or undue influence, and without any implied guarantee of cure. The Member further certifies that they are not affiliated with any governmental, regulatory, or oversight agency.

  11. Access to Full Membership Benefits:
    Full access to the benefits provided by HCU Mushrooms Ltd is contingent upon the Member’s ability to:
    a. Verify that they are at least twenty-one (21) years of age and a resident of the state of Colorado;
    b. Complete a screening form and engage in a consultation with a senior member regarding the intended use of services; and
    c. Execute a comprehensive membership agreement and remit the required annual fee.

  12. Entire Agreement:
    This Agreement constitutes the entire understanding between the parties and supersedes any and all prior agreements or understandings, whether written, oral, or implied. The Member acknowledges that they have read and fully understand the contents of this document, and that all inquiries have been satisfactorily addressed. The Member further understands that they may terminate this Agreement and their membership at any time.

 

 

 

By executing this Agreement electronically or otherwise engaging in the use of the Association’s services, the Member hereby consents to all terms and conditions contained herein.
